US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. After his return to the United States to face human smuggling charges, he was detained in federal detention.
In her decision, the judge noted that the government does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."
Context of the Case
The court challenge involve conflicting assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in Tennessee.
Terms of Freedom
The court, who was overseeing his petition to deportation in a federal court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
This ruling marks a significant turn in a complicated immigration case featuring claims of mistaken imprisonment and disputed gang affiliations.
